§ 631.52 — Effect of Certain Convictions on Custody and Parenting Time Rights

Plain-Language Summary

When a parent with custody or parenting time rights is convicted of certain serious crimes (like murder, assault, kidnapping, sexual offenses, or child abuse), the court must send the case to family court. The family court can transfer custody to the other parent or suspend the convicted parent's parenting time. The convicted parent must prove that continued custody or visitation is in the child's best interest.

Practical Notes
This law shifts the burden of proof to the convicted parent. If the victim was a family member, the convicted parent must prove their case by clear and convincing evidence, a higher standard. A guardian ad litem is always appointed to represent the child’s interests in these proceedings.
